Acceptance
By using this website you agree to these terms. If you do not agree with them, please stop using the site. We may update these terms, and the date at the top of the page shows when we last did.
Using this website
You may read, print, and share the pages of this site for your own business purposes. You agree not to:
- Attempt to gain unauthorized access to any part of the site or its hosting
- Interfere with its normal operation, including through automated traffic that degrades service
- Use the contact form to send unsolicited advertising, malicious content, or anything unlawful
- Scrape or copy the site's content to represent it as your own
We may block access where we reasonably believe the site is being misused.
Intellectual property
The Senka Advisory name, the mark, the written content, and the design of this site belong to us unless stated otherwise. You may quote short extracts with attribution and a link. You may not reproduce substantial parts of the site without written permission.
Engagements and proposals
Nothing on this website is an offer to enter into a contract. Prices, timelines, and scope are set out in a written proposal and take effect only once both sides have agreed to that proposal in writing.
Where a signed proposal, statement of work, or master services agreement conflicts with these terms, that document takes precedence for that engagement.
Deliverables and ownership
Unless a signed proposal says otherwise, once you have paid in full, the deliverables we create specifically for you are yours to use, adapt, and publish.
We keep ownership of our own pre-existing materials, methods, templates, and tooling, and of anything we built before or independently of your engagement. Where those are embedded in a deliverable, you get a perpetual licence to use them as part of that deliverable.
We may describe the engagement in general terms as a reference, and use your name and logo as a client, unless you tell us in writing that you would rather we did not.
Fees and payment
Fees, milestones, and expenses are set out in the proposal. Invoices are due within the period stated on the invoice. If work is paused or cancelled by you, we invoice for the work completed and any commitments already made on your behalf, such as participant incentives.
Confidentiality
Each side agrees to keep the other's confidential information confidential, to use it only for the engagement, and to protect it with reasonable care. This does not cover information that is already public, that a side already knew, or that must be disclosed by law.
Research participant data is handled under the separate consent given by each participant, as described in our privacy policy.
What we do and do not promise
We promise to perform our services with reasonable skill and care, to staff them with people competent to do the work, and to be straightforward about the strength of the evidence behind any recommendation.
We do not promise a particular commercial outcome. Research describes what we observed within a stated sample and time window, and business results depend on decisions and conditions outside our control. Our work is not legal, financial, medical, or regulatory advice, and you should take professional advice before acting where those apply.
The website itself is provided as it is. We do not warrant that it will be uninterrupted or free of errors.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, or loss of anticipated savings arising from the use of this website or from our services.
Our total liability in connection with an engagement is limited to the fees you paid us for that engagement. Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
Third party links
This site links to external services such as LinkedIn. We do not control those sites and are not responsible for their content or their privacy practices.
Governing law
These terms are governed by the laws of the State of California, and the courts of California have exclusive jurisdiction over any dispute, without affecting any right you have to bring a claim where you live.

These terms are a working starting point written for this site as built. Before you publish, confirm the legal entity name, the governing jurisdiction, and the payment and liability clauses with a qualified advisor, particularly if you are contracting with larger companies.
